Heard Ms. S. Debbarman, learned counsel appearing for the petitioner. Also heard Mr. Kohinoor N. Bhattacharya, learned G.A. appearing for the respondents –State. [2]
This petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:-
“(i) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to modify the Notification, dated, 14.11.2019, issued by the Under Secretary to the Govt. of Tripura. (ii) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby quashing and cancelling the Memorandum, dated, 20.11.2021. (iii) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to stop deduction @ Rs. 14, 815/-, being caused from the monthly salary of the Petitioner w.e.f. April 2023 to till date. Page 2 of 2
iv) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to refund the deducted amount from the salary of the Petitioner w.e.f. April, 2023 towards recovery of Rs. 17,77,752/- deducted @ Rs, 14,815/- which is being caused from the monthly salary of the Petitioner w.e.f. April, 2023 to till date. (v) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to treat the period from 01.05.2019 to October 2021 as on study leave. (vi) Call for the records pertaining to the instant Writ Petition from the custody of the Respondents.
(vii) Make the Rules absolute after hearing the Parties.”
[3] After perusal of the record, it is seen that the petitioner herein submitted a representation dated 04.06.2022 and subsequent thereto a reminder letter dated 30.09.2024 addressed to the concerned respondent(s) representing the hardships of the petitioner. But till date the same are pending with the concerned respondent(s). [4] In view of the same, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to decide the matter upon the representations dated 04.06.2022 and 30.09.2024 within a period of 02 (two) months from the date of receipt of the copy of this order in accordance with law. [5]
With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. JUDGE
