NC: 2025:KHC:9527 WP No. 1635 of 2025
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA
ORAL ORDER
1. The revenue entries were mutated on the basis of the registered sale deeds, which lead to filing of an appeal by the petitioner on the ground that, in respect of the very lands in question, a suit in O.S.No.8912/2005 was pending consideration.
2. The Assistant Commissioner, however, dismissed the appeal on the ground that, once there was a sale deed, the Revenue Authorities were bound to give effect to the sale deed and the entries were required to be changed notwithstanding the fact that the suit was pending.
3. The Assistant Commissioner also stated that the petitioner was at liberty to approach the Revenue Authorities after the outcome of O.S.No.8912/2005.

NC: 2025:KHC:9527 WP No. 1635 of 2025
This order of the Assistant Commissioner has been upheld by the Deputy Commissioner by dismissing the revision filed by the petitioner.
4. In the light of the fact that the Assistant Commissioner has already stated that the revenue entries made by the Authorities be subject to the ultimate result of the civil suit pending between the parties in O.S.No.8912/2005, the writ petition does not deserve to be entertained.
5. It is submitted that O.S.No.8912/2005 has been
disposed of, as against which, a Regular First Appeal in RFA.No.2090/2022 is filed and the same is pending before this Court.
6. It is therefore obvious that the revenue entries that have been made by the Authorities would be subject to the ultimate result of this Court in RFA No.2090/2022.
7. This petition is accordingly disposed of.
