1. Heard learned Counsel Mr. D.Kalita for the petitioner Bittu Paswan who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 03.06.2025 in connection with Chandmari PS Case No. 142/2025 under Sections 331(4)/305(a)/3(5) of the BNS,2023.

2. Mr. P.Borthakur, learned Addl.Public Prosecutor is present for the State respondent and has raised serious objection in granting bail to the petitioner.
3. It is submitted that there are incriminating materials in the Case Diary against the petitioner. The petitioner is deeply involved in theft and co-accused have also been arrested.
4. The FIR unfolds that on 28.05.2025, at about 4.20 am, the informant discovered that the door of her storeroom was broken and many items from her shop were stolen. During investigation of the alleged offence, the petitioner was arrested.
5. I have scrutinized the Case Dairy. Indeed there are incriminating materials in the Case Diary against the petitioner. I have also considered the progress of the investigation. It appears that further custodial detention is not required.
6. It appears that bail may be granted to the petitioner.
7. The petitioner named above shall be released on bail on furnishing bail bond of Rs.30,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup(M), Guwahati subject to the following conditions: i) That the petitioner shall co-operate with the investigation, ii) That the petitioner shall appear before the I.O. every fortnight till completion of the investigation, iii) That the petitioner shall not leave the jurisdiction of the Court without prior permission.

8. On breach of any of the above conditions, the learned Court is at liberty to immediately cancel the bail granted to the petitioner.
9. In terms of the above observations, the bail application stands disposed of.
10. Send back the Case Diary.
