Singh, learned Standing Counsel for the respondents-State No.1 & 2, Shri Kumar Ayush, learned counsel appearing for respondents No.3 to 5 and Shri Ran Vijay Singh, learned counsel appearing for respondent No.6. 2. There is consensus at bar that subsequent to the order impugned order dated 15.02.2025 whereby the claim of the petitioner for payment of salary for the post of In-charge Principal has been rejected, a copy of which is Annexure-1 to the petition, Division Bench of this Court in Special Appeal No.652 of 2024 In Re Secretary, U.P. Basic Education Board & 2 Ors vs Tripurari Dubey and Ors., vide judgment and order dated 30.04.2025 has issued certain guidelines on the basis of which the In-charge Head Master would be paid salary for the said post. 3. It is submitted that impugned order may be set aside with liberty to the respondents to proceed in accordance with the guidelines issued by the Division Bench of this Court in the case of Tripurari Dubey (supra). 4. Considering the aforesaid, the writ petition is disposed of. Order impugned dated 15.02.2025, a copy of which is Annexure-1 to the petition, is set aside. 5. The respondents are directed to reconsider the claim of the petitioner for payment of the salary for the post of In-charge Head Master in terms of the guidelines issued by the Division Bench of this court in the case of Versus Counsel for Petitioner(s) : Abhishek Tiwari, Vinay Kumar Counsel for Respondent(s) : C.S.C., Kumar Ayush, Ran Vijay Singh Vandana Tiwari .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy./ Prin. Secy. Basic Edu. Deptt. U.P. Govt. Lko. And 4 Others .....Respondent(s) Tripurari Dubey (supra) within a period of 4 weeks from the date of receipt of a certified copy of this order.
