Learned counsel for the petitioner submits that while passing the suspension order dated 17.04.2025, opposite party no. 3 did not record any subjective satisfaction indicating that the charges mentioned in the said order, if established, would warrant the imposition of a major penalty. After arguing for some time, learned counsel for the petitioner prays that he may be permitted to submit a representation before respondent no. 3 seeking revocation of the suspension
order in terms of Rule 4(8) of the Uttar Pradesh Government Servant (Discipline and Appeal) Rules, 1999, with a direction for its expeditious consideration. Considering the aforesaid submission and without expressing any opinion on the merits of the case, the writ petition is
disposed of with liberty to the petitioner to file an appropriate representation before respondent no. 3 within ten days from today. In the event such representation is submitted, the same shall be considered and decided by respondent no. 3 within a further period of two weeks, in accordance with law.
