Ibotombi, learned senior counsel for the respondent No.2 & 3. [2] This contempt case has been initiated by the complainant/petitioner for seeking intervention of the order rendered by the learned Single Judge on the writ side in WP(C) No.369 of 2023 dated 20.01.2025 (Annexure C/6), this contempt proceeding has been initiated keeping in view of the provision of sections 12 and equally section 2(b) of Contempt of Courts Act,1971. [3] In this proceeding, the said learned senior counsel, Mr. N. Ibotombi, for the respondent Nos. 2 & 3 facilitating the order dated 02.06.2025 issued by the Government of Manipur/Office of the Commissioner of Excise, Manipur, this order consisting of all para Nos. 1-16 but in para No.16 indicating that in light of the clarification at para JOHN TELEN KOM Digitally signed by JOHN TELEN KOM Date: 2025.09.01 14:14:52 -07'00' 2 No.16 above and as instruction by the office of the Principal Accountant General(A&E), Manipur vide their letter No. LC/1-75/WP(C) 636/2019/2023/1238 dated 25.03.2025 to avoid further legal compliances, the pay scale of Excise Department, will be adopted as follows: a. In Service – Excise Employee. - Since the new ROP 2019 has been implemented, the pay scale is to be revised and fixed in the corresponding downgraded scale of pay as per Rule3(3) of the Manipur Service(Revised Pay) Rules, 2010 read with Finance Department(PIC), Government of Manipur Notification No.1/122006-FD(PIC) dated 28/12/2006 and clarification No.16 of the Department’s OM No.1/4/2008-FD(PIC) (Pt.)(3) dated 07/07/2010. b. Pensioner-Excise Department. - Pay fixation and payment of pension is to be calculated and fixed on the basis of the substantive scale of pay to be drawn on the date of their retirement as per Rule3(3) of the MS(RP) Rules, 2010 read with FD(PIC), Government of Manipur Notification No.1/12/2006-FD(PIC) dt.28.12.2006 and clarification No.16 of the Department’s OM No.1/4/2008-FD(PIC) (Pt.)(3) dated 07/07/2010. - [4] However, the learned senior counsel in the aforesaid writ petition submitted that the order has been complied by competent authority in the rank of the respondents. 3 [5] Keeping in view of the submission made by the learned senior counsel for the respondent Nos. 2 & 3 and also order rendered by the competent authority on 02.07.2025, the present contempt case does not have any substance and hence, does not survive for consideration in further in this matter. Consequently, the present contempt case is hereby closed. [6] In the meanwhile of closing this contempt petition in pursuant to the order rendered by the competent authority, the learned counsel for the petitioner seeks liberty.
