The petitioner claims to have been granted fisheries right in respect of Gata No.399 situated in Village Rasoolpurkala, Pargana Rudauli, Tehsil Ramsanehighat, District-Barabanki sometime in 2016 after cancellation of the patta of the earlier lessee, who filed a revision challenging the allotment to the petitioner which was registered as Case No.01540/2017 Computerized Case No.C201704000001540 (Ram Jeet vs. Mintu). The said revision was dismissed on 19.03.2025. We asked learned Counsel for the petitioner as to whether there was any stay operating during pendency of the revision, learned Counsel submitted that there was no stay during the revision. It being so, we fail to understand as to how and why this petition has been filed in the year 2025 seeking a mandamus to opposite party No.2 and 3 to give possession of Gata No.399 aforesaid. If there was no stay and there was an allotment in favour of the petitioner but possession was not being given then he should have agitated the matter timely. We, therefore, see no reason to interfere in the matter at this belated stage but leave it open for the petitioner to approach the authorities concerned, if there is a cause. 3.
