The present criminal misc. application under Section 482/483 of the Code of Criminal Procedure filed on behalf of the Applicants, Rahul Kumar S/o Shri Vinod Kumar, Vinod Kumar S/o Shri Dhram Pal Singh, Laxman Singh @ Lucky S/o Shri Vinod Kumar and Smt. Sudharani W/o Shri Vinod Kumar against the Respondent in particularly Respondent no.2, Smt. Preeti Verma W/o Shri Rahul Kumar D/o Shri Rajesh Kumar, who is the complainant; the present application comes with the prayer that the impugned charge-sheet submitted by the Investigating Officer, cognizance order dated 24.01.2024 as well as the entire proceedings of Criminal Case No.58 of 2024, titled as “State vs. Rahul Kumar & Others”, punishable under Sections 323, 498-A, 504 & 506 of IPC and Section 3/4 of D.P. Act, Police Station Kotwali Laksar, District Haridwar, pending in the court of learned Additional Chief Judicial Magistrate, Laksar, District Haridwar against the Applicants be quashed. 5. The Compounding Application (IA No.02 of 2025) is also annexed with the present application that is 2025:UHC:10934 supported with the affidavits of the parties and the said application is being endorsed by the learned counsel for the Applicants and Respondent no.2, Mr. Aditya Singh, Advocate and Mr. Sanjeev Singh, Advocate respectively. 6. The Applicants and Respondent no.2/complainant are present through V.C. before this Court, who are identified by their respective counsel. 7. After interacting with the parties especially with Respondent no.2, Smt. Preeti Verma (complainant), she makes a statement that the parties have amicably settled their dispute outside the Court by way of settlement/undertaking dated 04.10.2025, wherein it has been mentioned that Respondent no.2 will withdraw the proceedings of Criminal Case No.58 of 2024, titled as “State vs. Rahul Kumar & Others”. Since the parties have already entered into a compromise so arrived at between the parties, hence, the impugned charge-sheet, the impugned cognizance order as well as the proceedings of Criminal Case No.58 of 2024 may be quashed, whereas learned State counsel poses his formal objection in this regard. 8. In view of the principle of law laid down by Hon'ble the Apex Court in the case of “Gian Singh vs. State of Punjab” reported in 2012 (10) SCC 303 as well as in Transfer Petition (Criminal) No. 115 of 2012 (Dimpey Gujral vs. Union Territory of Chandigarh) decided on 06.12.2012, criminal proceedings can be quashed by this Court, if this Court is satisfied with the facts and circumstances of the case. 9. Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that 2025:UHC:10934 ends of justice would be met, if the entire proceedings against qua the Applicants are hereby quashed. 10. In view of the above, the compounding application is allowed. The impugned charge-sheet submitted by the Investigating Officer, cognizance order dated 24.01.2024 as well as the entire proceedings of Criminal Case No.58 of 2024, titled as “State vs. Rahul Kumar & Others”, punishable under Sections 323, 498-A, 504 & 506 of IPC and Section 3/4 of D.P. Act, Police Station Kotwali Laksar, District Haridwar, pending in the court of learned Additional Chief Judicial Magistrate, Laksar, District Haridwar against the Applicants, are hereby quashed. 11. The present Criminal Misc. Application u/s Section 482 of the Code of Criminal Procedure is, thus, disposed of in terms of the compromise arrived at between the parties.
