1. Heard Mr. G.N. Sahewalla, learned Senior Counsel assisted by Ms. K. Bhattacharya, learned counsel for the petitioner. Also heard Mr. R. Sharma,
learned counsel for the respondent nos.2 & 3. Mr. G. Bokalial, learned counsel appears for the respondent no.1. 2. The petitioner is aggrieved with the impugned order of attachment of immovable property dated 30.05.2025 and the impugned notice of attachment dated 30.05.2025, on account of the petitioner not having paid the pending PF dues amounting to Rs.3.97 crores. 3. Mr. G.N. Sahewalla, learned Senior Counsel for the petitioner submits that the petitioner should be allowed to pay the pending PF dues of Rs.3.97 crores in four instalments within one year, besides the petitioner paying the monthly PF dues. He submits that the petitioner should be allowed to submit Rs.50 lakhs in
Page No.# 3/4 the month of June and Rs.50 lakhs in the month of July, 2025. Thereafter, the petitioner will complete the payment of the pending dues of Rs.3.97 crores within a year, w.e.f. 01.06.2025. 4. Mr. G.N. Sahewalla submits that the petitioner was given a letter dated 06.05.2025 from the Secretary-cum-P.F. Commissioner, Board of Trustees, Assam Tea Employees Provident Fund Organization, requesting the petitioner to appear before the Hon’ble Chairman of Board of Trustees on 13.05.2025 at 11:00 a.m in the Board’s office, “Nidhi Bhawan”, Basistha, Lalmati, N.H-37, Guwahati-29 along with necessary Deposit Challans/Document, in support of deposit of arrear P.F. Contribution and other dues. 5. The petitioner’s counsel submits that the petitioner prayed for some time to appear before the Hon’ble Chairman of the Board of Trustees and till date no meeting has been held between the petitioner and the Hon’ble Chairman of the Board of Trustees, in pursuance to the letter dated 06.05.2025 issued by the Secretary-cum-P.F. Commissioner, Board of Trustees, Assam Tea Employees Provident Fund Organization. 6. Mr. G.N. Sahewalla submits that a date for a meeting may be fixed, on which date the petitioner shall appear before the Hon’ble Chairman of the Board of Trustees and the arrear P.F. contribution that is liable to be paid by the petitioner, should be clarified, by way of an order by the Hon’ble Chairman of Board of Trustees. 7. Mr. R. Sharma, learned counsel appearing for the respondent no.2 & 3 submits that he has got no objection to the prayer made by the petitioner’s counsel. 8.
In view of the consent of the parties, the Chairman of the Board of
Page No.# 4/4 Trustees, Assam Tea Employees Provident Fund Organization, shall fix a date for a meeting to be held with the petitioner. Thereafter the Chairman of the Board of Trustees shall pass an order, stating the arrear P.F. contribution and other dues that may be payable by the petitioner. Till then, no coercive action should be taken by the respondents. 9. The writ petition is accordingly disposed of. JUDGE Comparing Assistant
