Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.1043 of 2023 of Bhavanipuram Police Station, Vijayawada, registered for the offence punishable under Section 420 of the Indian Penal Code, 1860, on the strength of the complaint of the 2nd respondent alleging the non-payment of the flight ticket price by the accused. 3. The learned counsel for the petitioner submits that the petitioner was falsely implicated in the present crime. The learned counsel further submits that the offence alleged against the petitioner is punishable for up to 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Bhavanipuram Police Station, Vijayawada, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.1043 of 2023. This order would not preclude the investigation officer 3 CRL.P. No.3751 OF 2025 from filing a charge sheet or final report after completion of the investigation. 5.
