2. Mr. Deepak Bisht, learned Deputy Advocate General for the State. 3. Mr. B. S. Kathayat, learned counsel for the respondent no.2. 4. Both the parties, the petitioner K.Subharaman and respondent no. 2 Dr. Prabhat Kumar Bharadwaj are present through V.C. and are identified by their respective counsels. 5. A compounding application No. IA 1 of 2025 has been filed for compounding the case in terms of mutual settlement between the parties. Para 5 to 7 of the Compounding Application reads as under:
“5. That it is relevant to mention here that during pendency of present C-482 Petition the applicant and deponent (respondent no.2) have amicably settled the dispute between them. 6.That now the accused-applicant and deponent herein have settled the dispute amicably by mutual consent and parties are ready to compound the aforesaid criminal case, as the deponent does not want to persecute the accused/applicant herein in the aforesaid criminal case. 7. That since the deponent does not want to prosecute the accused/applicant in the aforesaid case crime and also the parties have entered into compromise, therefore, to continue the proceeding of Complaint Case No. 6641 of 2006, Dr. Prabaht Kumar Bharadwaj vs. Unichem Laboratories Ltd. &
another (new number S.T. No. 201 of 2016, State vs. Unicheme Laboratory Limited and another under Section 274 and 275 of IPC, P.S. Kashipur) at present pending before the leaned Second additional Sessions Judge, Kashipur, District Udahm Singh Nagar would be a futile exercise and deponent/respondent no.2 will not have any objection, if, entire proceedings of Complaint Case No. 6641 of 2006, Dr. Prabhat Kumar Bharadwaj vs. Unicheme Laboratories Ltd. & another (new number S.T. No. 201 of 2016, State vs. Unichem Laboratory Ltd. and another under sections 274 & 275 of IPC, PS Kashipur, at present pending before the learned 2nd Additional Sessions Judge, Kashipur, District Udham Singh Nagar is quashed by this Court in view of the fact, that the parties have been entered into compromise.”
6. Both the parties agreed that they have filed the Compounding Application and are ready for compounding in terms of the settlement reached between the parties. 7.
In view of the above, the Compounding Application is allowed. Accordingly, the impugned order dated 04.10.2016, passed by the learned Additional Chief Judicial Magistrate, Kashipur, Udham Singh Nagar in Complaint Case No. 6641 of 2006, Dr. Prabhat Kumar Bharadwaj vs. Unichem Laboratories Ltd. and another, U/s 274 & 275 IPC, PS. Kashipur, District Udham Singh Nagar, as well as the entire proceedings of the aforesaid case are quashed, qua the applicant. (Subhash Upadhyay, J.)
