The instant petition has been filed against the impugned judgment and order dated 15.03.2022 passed by the leaned Commercial Court, Gautam Buddh Nagar and Award dated 03.07.2017. Learned counsel for the petitioner submits that the issue in hand is squarely covered by the order of this Court passed in Matters under Article 227 No.1836 of 2023 (M/S Devi Dayal Charitable Trust and 2 others Vs. M/S Rajhans Towers Pvt Ltd), decided on 17.05.2025. The said submission made by the learned counsel for the petitioner, is not disputed by the learned counsel appearing for the respondents. In view of the above, the impugned order dated 15.03.2022 passed by the leaned Commercial Court, Gautam Buddh Nagar and Award dated 03.07.2017 are set aside. Accordingly, this petition is allowed in terms of the order of this Court passed in M/S Devi Dayal Charitable Trust (supra).
