THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.3688 OF 2025 ORDER:
1. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No.252 of 2024 of Nandyala III Town Police Station, Nandyala District, registered for the alleged offence under Sections 118(1), 115(2), 351(2), 79 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, ‘B.N.S.’) at the behest of the 2nd respondent.
3. The learned counsel further submits that the petitioner and his father were arraigned as A.1 and A.2. It is submitted that a false complaint was registered against the petitioner at the behest of the second respondent.
4. The learned counsel submits that the petitioner and his father were travelling on a bike at the time of the incident, and as such, there was no scope for his involvement in the alleged offence.
5. The learned Assistant Public Prosecutor submits that the provision of law was altered to Section 118(2) of B.N.S., upon receipt of the wound certificate from the competent medical officer and that the petitioner’s father has already been remanded to judicial custody.

Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Nandyal III Town Police Station, is directed to complete the investigation without taking any coercive steps against the petitioner. This order would not preclude the investigation officer to file charge sheet or final report after completion of investigation.
7. Accordingly, the criminal petition is disposed off.
