HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU SWP No. 537/2016 Naresh Kumar & Anr. …..Appellant(s)/Petitioner(s) Through: None. q vs SKAUST & Anr. .…. Respondent(s) Through: None. CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDER 20.12.2025 01. The petitioners claim to have been engaged as casual labourers in the years 2006 and 2007, respectively, and were later disengaged by the respondents vide order dated 17.09.2009. 02. This petition was filed by the petitioners in the year 2016 to quash the order dated 17.09.2009 and, therefore, this Court on the very first date of hearing, i.e., 15.03.2016, flagged the issue of maintainability of this petition on account of delay and laches. 03. Notice in this matter was issued on 15.03.2016, and the matter has not come up for consideration thereafter. No efforts have been made by the petitioners to get the matter listed. Since the petitioners were disengaged in the year 2009, as such, they may have either been adjusted somewhere else or lost interest in pursuing this petition. The relief of challenging their disengagement made in the year 2009 and their reinstatement in the year 2025 cannot be granted at this stage. The petitioners appear to have realised the futility of this petition and, therefore, have chosen not to pursue it since February 2016. 04. In view of the above, the petition is dismissed for non-prosecution. 05. (Sanjeev Kumar) Judge Jammu 20.12.2025 Abinash 44
