And 3 Others Counsel for Petitioner :- Onkar Singh,Satya Narayan Yadav Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondents no. 1 to 3. In view of the proposed order, notice to respondent no. 4 is dispensed with. The petitioner has filed this writ petition seeking a mandamus directing the authorities to appoint her to the post of Anganwadi Karyakatri.
Learned counsel for the petitioner submits that she belongs to the BPL category. Although respondent no. 4 also claims to belong to the BPL category, she was issued an incorrect certificate by the concerned Tehsildar. An inquiry was conducted at the Tehsil level, and a recommendation was made for cancellation of the income certificate of respondent no. 4. However, Tehsildar, Balrampur, has not acted upon the recommendation and has yet to forward the report to the District Program Officer, Balrampur and due to that no decision has been taken. Learned Standing Counsel, opposing the petition, submits that respondent no. 4 was selected under both the EWS and BPL categories on the basis of higher marks in the merit list. He further submits that, as per paragraph 5 of the relevant instructions, no report from Tehsildar, Balrampur has been received by the District Program Officer regarding the claims
made in the petition concerning the cancellation of the income certificate of respondent no. 4. In view of the above, Tehsildar, Balrampur, is directed to submit an appropriate report regarding the EWS/BPL certificate of respondent no. 4 to respondent no. 3 within three weeks. Thereafter, the District Program Officer shall take an appropriate decision within a further period of two weeks regarding selection of respondent no. 4. With these observations, the petition stands disposed of. The instructions provided by the learned Standing Counsel are taken on record. The petitioner is directed to implead Tehsildar, Balrampur, during the course of the day.
