The instant application has been filed by the applicant seeking anticipatory bail in Case Crime No.102 of 2025 under Sections 69, 351(3), 352 of B.N.S. registered at Police Station- Ashiyana , District- Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 28.03.2025 stating that the informant had come to Lucknow in the year 2018 for taking admission in GNM course, the applicant developed a relationship with her and started making physical relations under allurement of marrying her. The applicant had got her employed for 3-4 months in the year 2018. The informant got a Government job in the year 2023 and the applicant used to take away her salary. The applicant made physical relations with the informant on 15.02.2025 and thereafter declined to marry her. Subsequently, the informant came to know that the applicant is a married man. 4. In the affidavit filed in support of the application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case. It has further been stated that the informant used to take money from the applicant and some documents have been annexed evidencing online payments of various amounts by the applicant to the informant. 5. The applicant's involvement in three other criminal cases has been disclosed in para 20 of the affidavit, in one of the cases, the allegations could not be established during investigation and the Investigating Officer has submitted a closure report dated 25.05.2023 and in the other two cases relating to Section 406 and 420 IPC, the charge-sheet has been submitted and merely this much has been stated "No bail". 6. Learned AGA has opposed the application and he has submitted that the investigation of the case is still pending. 7. Having considered the aforesaid facts and circumstances of the case and keeping in view the nature of allegations levelled against the applicant as well as his criminal history which shows that although charge-sheet has been submitted against him in two matters, he has not applied for bail, from which it appears that he is habitual of not co-operating with the proceedings, I am of the view that the aforesaid facts do not warrant exercise of discretion of this Court by granting pre- arrest bail to the applicant. 8. Accordingly, the anticipatory bail application is hereby rejected. 9. In case the applicant files an application for his release on bail, the same shall be considered and decided without getting influenced by rejection of his anticipatory bail application. .
