The present petition has been filed for the following relief: " (i) To issue a direction while directing the Civil Judge Senior Division Malihabad Lucknow to decide the Misc. case No. 281/2025 Rakesh Kumar Gautam and other versus Usha Devi (Recall application moved under order 9 rule 13 of the C.P.C. for recalling ex-party order) in regular suit No. 1505/2017 Usha Devi and others versus Rakesh kumar Gautam and others on the date fixed i.e. 04.07.2025 or within stipulated period pending in the Court of Civil Judge (S.D.) Malihabad Lucknow contain as Annexure No. 3 to this petition in the interest of justice." 3. Considering the relief as prayed for, the present petition is disposed of directing the Court concerned to decide the aforesaid case with all expedition, preferably within a period of four months from the date of filing of a certified copy of this order, in accordance with law.
