3. By means of the present writ petition, petitioners have challenged the order dated 07.08.2023, passed by 7th Additional Senior Civil Judge, Dehradun in O.S. No.336 of 2014, Smt. Neena Saxena vs. Sri Dinesh Chandra Maheshwari, whereby the application moved by the respondents/plaintiffs under Order 6 Rule 17 has been allowed.
4. Since the order passed in the amendment application is revisable, the writ petition is not maintainable before this Court under Article 227 of the Constitution of India.
5. At this stage,
learned counsel for the petitioners/defendants submitted that he wants to withdraw the present writ petition to enable him to file a civil revision before the District Judge.
6. Permission, as sought, is granted.
7. Accordingly, the writ petition is dismissed as withdrawn. However, the petitioners/defendants are at liberty to avail themselves of the appropriate remedy available to them under the law.
