( 2025:JHHC:22730 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 5328 of 2025 Mohan Sah @ Mohan Kumar Saha, aged about 32 years, son of Ram Lal Saha, Kelabari, P.O. & P.S.- Radhanagar, District- Sahibganj. …. Petitioner Versus The State of Jharkhand …. Opp. Party ------ CORAM : HON’BLE MR. JUSTICE AMBUJ NATH ------ For the Petitioner : Ms. Neetu Singh, Advocate Mr. Vishal Kumar Rai, Advocate For the Opp. Party : Mr. Bhola Nath Ojha, A.P.P. ----- 3/ 08.08.2025 Heard the parties. 2. Petitioner has been made accused in connection with Barharwa P.S. Case No. 101 of 2023, for the offences registered under Sections 21(c) of the NDPS Act and Sections 27(b)(ii) and 28A of the Drugs and Cosmetic Act, 1940, pending in the Court of learned Sessions Judge, Sahibganj. 3. Prayer for bail of this petitioner was earlier rejected by this Court vide B.A. No. 832 of 2025 by order dated 25.03.2025. 4. On 03.07.2023 at about 6.15 am., Barharwa Police intercepted an autorickshaw and apprehended the co-accused Sunil Saha @ Sunil Kumar Saha while other accused managed to flee away. On search, about 140 bottles of Codeine Phosphate Syrup of 100 ml each was recovered. 5. It appears that co-accused Sunil Saha just after his arrest, confessed that the petitioner had managed to flee away. It also appears that mobile phone of the petitioner was also seized from the autorickshaw. 6. The report regarding the stage of trial, earlier called for, has been received. It appears that out of six witnesses, two witnesses have been examined and four witnesses are yet to be examined. 7. Considering the nature of allegation and the fact that the trial is in progress, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected. 8. Learned Trial Court shall expedite the trial and conclude the same, preferably within six months, from the next date fixed for recording of evidence. (Ambuj Nath, J.) R.Kr.
