Sarmah, learned counsel for the AFDC submits that the present writ petition has become infructuous, in view of the fact that the petitioner is the 4th highest bidder for settlement of the fishery. However, the petitioner has not impleaded 2nd and 3rd highest bidder. He also submits that the settlement of the fishery with the highest bidder, i.e., the respondent No.4, has been cancelled after settlement of the fishery. 3. Mr. H.R. Das, learned counsel appears for the respondent No.4 and submits that the respondent No.4 has not put to challenge the cancellation of the settlement of the fishery with the respondent No.4. 4. On considering the fact that the petitioner has not appeared on the last two dates, this Court is of the view that the petitioner is not interested in pursuing the matter.
