Rai, Advocate For the State : Mr. Sudhir Kr. Mahto, Addl.P.P ------ Order No.02 Dated- 15-07-2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Deori P.S. Case No.05 of 2025 registered for the offences punishable under section 64/351(2)/352 of the B.N.S., 2023. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner committed rape upon the victim and has captured the same in video and photographs. It is further submitted that the allegations against the petitioner are all false. It is next submitted that though the alleged occurrence took place on 26.04.2024 but the FIR was registered only on 19.01.2025. It is next submitted that prior to that, the mother of the petitioner lodged Sanha No.47 of 2025 in the Court of learned Chief Judicial Magistrate, Giridih wherein she mentioned about the threatening of implication of the petitioner in false rape case, given by the informant. It is next submitted that as mentioned in para-74 of the case diary, for the occurrence which took place on 08.11.2024 and 10.11.2024 for which cases were instituted by both the parties but in that case, there is no reference to the occurrence which took place prior to that on 06.04.2024. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertake that they will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 19.03.2025 as is evident from para-21 of this bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Giridih, in connection with Deori P.S. Case No.05 of 2025 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
