The petitioners seek initiation of contempt proceedings against the respondents for willful disobedience of the interim order dated January 10, 2014, passed in CMA No. 72 of 2014 in SWP No. 65 of 2014 (Vijay Kumar and Anr. Vs State of J&K and Ors.) vide which the Writ Court while issuing notice had also observed that two posts of Lab Assistants in Jammu District shall not be filled until further orders.
Records show that vide a subsequent order dated July 08, 2022, the main case (SWP No. 65 of 2014) itself was transferred to the Central Administrative Tribunal (CAT), Jammu Bench, Jammu in view of the Notification No. G.S.R.317(E) dated 28th May 2020 issued by the Central Government under Section 5(7) of the CAT Act.
For, over 11 years have gone by, none is present on behalf of the petitioners to confirm if the matter is still pending adjudication before the Tribunal.
Thus, the Court is choiceless but to dismiss the petition for non prosecution.
Dismissed for non prosecution.
