Julius Riamei, learned counsel along with Mr. Stephen P, learned counsel for the petitioner and Mr. Niranjan Sanasam, learned Government Advocate for respondent Nos. 1 & 2 appearing through video conferencing. [2] By the present petition, the petitioner prays for issuance of a writ of mandamus or any other writ directing or designating District Judge, Senapati or any other person as Arbitrator under Section 3G of National Highway Act, 1956. [3] Earlier, the petitioner approached this Court by way of WP(C) No. 454 of 2024 and vide order dated 09-04-2025, the matter was disposed of as Arbitrator had already been notified by the competent authority. However, the Joint Secretary (Land Resources), Government of Manipur wrote a letter dated 26-02-2025 to the Executive Director (P), NHIDCL, RO-Manipur, Imphal for nomination of a new Arbitrator as the present Arbitrator was unable to perform her duties due to the current situation. WP(C) No. 464 of 2025 [4] This Court has perused the material on record and is of the opinion that the writ petition may be disposed of at this stage by directing respondent No. 3, NHIDCL to notify a new Arbitrator as requested by the State Government in terms of the letter dated 26-02-2025 or any other person who will be able to discharge the duty of arbitration under the Act. [5] In the circumstance, respondent No. 3, NHIDCL, is directed to appoint Arbitrator as prayed for within two weeks from the date of receipt of a copy of this order. [6] Furnish a copy of this order to the learned counsel appearing for the parties and send a copy of this order to respondent No. 3, NHIDCL for information and compliance.
