ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the Online Rejection Order passed by the 4th Respondent thereby rejected petitioner’s Mee-seva Application dated 16.02.2024 submitted for online mutation and issuance of E-Pattadar Passbook-cum-Title Deed pertaining to petitioner’s agricultural landed properties admeasuring Ac.1.34 cents in Survey No.476 situated in Anakapalli Revenue Village and Mandal of Anakapalli District, without assigning any reasons as illegal, irregular, irrational and violative of the provisions of Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 and rules framed there under and offends Articles 14 and 21 of the Constitution of India and consequently direct the 4th Respondent to issue E-Pattadar Pass Book- cum-Title Deed and mutate Petitioner’s name in onlie web land record of rights and pass…” .

2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

Learned counsel for the Petitioner submits that the agricultural landed property to an extent of Ac.1.34 cents in Sy.No.476 situated in Anakapalli Revenue Village and Mandal of Anakapalli District is in continuous possession and enjoyment of petitioner’s family for the last 85 years and above. Petitioner’s grandmother by name Appaiyamma had acquired the above subject land by succession. Petitioner’s grandmother died on 16.05.2020. After the death of petitioner’s grandmother, the petitioner is in possession and enjoyment of the subject agricultural land. Further, learned counsel for the Petitioner submits that petitioner’s grandmother submitted representation dated 14.12.2015 through ‘Meekosam’ to the 4th respondent requesting to grant pattadar pass book and title deed and also to mutate her name in all online web land revenue records that are being maintained by the 4th Respondent in respect of the subject land by duly enclosing relevant documents thereto as contemplated under Section 4(1) r/w Rule 18 of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and Rules framed thereunder. But so far no action was taken on such representation submitted by petitioner’s grandmother. The Petitioner herein made an application on 16.02.2024 for granting E-pattadar pass books and title

deeds and to mutate petitioner’s name in online web land of revenue records by enclosing the relevant documents. However, the 4th respondent rejected the petitioner’s application through the online portal without assigning any reasons. Hence, the present writ petition. 4. On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondents submits that the said rejection was made on technical grounds, but no reasons were assigned based on the documents submitted by the petitioner. Therefore, the rejection order issued by the 4th respondent dated 16.02.2024 on technical grounds is liable to be set aside. 5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, and on perusal of the material available on record, it is observed that the petitioner submitted an application seeking for mutation and grant of E-pattadar pass books and title deeds, along with relevant documents to substantiate his right over the subject property.
As such, the application of the petitioner seeking for mutation of his name in the revenue records in respect of the subject property should be considered by the respondents under section 5 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971. The

rejection order dated 16.02.2024 issued by the 4th respondent, without assigning any reasons, is contrary to the procedure laid down under Section 5 of the Act and is therefore liable to be set aside. 6. Accordingly, this Court is of the considered opinion that the present writ petition can be disposed of by setting aside the impugned order dated 16.02.2024 issued by the 4th respondent. Further, the matter is remanded to the 4th respondent, who should consider the application of the petitioner afresh with reference to Section 5 of the Act, and pass appropriate orders after providing an opportunity of hearing to the petitioner and other stakeholders, if any, within a period of two (02) months from the date of receipt of a copy of this order.
