ORAL ORDER
Petitioner is arrayed as an accused in Crime No.73/2024 registered at Ijuru Police Station, Ramanagara, for the offence punishable under Sections 408 and 420 of the IPC.
2. The complaint is lodged by one Pradeep.M. working as Branch Manager at Bharath Financial Inclusion Limited, Jeegenahalli, Ramanagara. It is alleged that the petitioner working as a Field Assistant and Branch Credit Manager has misappropriated a sum of Rs.10,79,234/- which was collected from various persons who availed loans.
3. The incident of misappropriation, as per complainant has taken place between 22.02.2022 till
30.06.2024. The incident is said to have come to light on 30.05.2024 when the Divisional Risk Control Manager visited the Branch office and found out shortage of cash in the locker.
4. It is not in dispute that the petitioner was working as a Field Assistant and Branch Credit Manager. However, the allegations that he has misappropriated a sum of Rs.10,79,234/- between 22.02.2022 and 30.06.2024, is a matter which has to be established in due course. As per

complaint, the petitioner was entrusted with the work of receiving the amount from various persons and deposit the said amount in their account. It is not stated in the complaint as to who are the other persons working in the said Bharath Financial Inclusion Limited during the relevant time. The prosecution has to establish the case against the petitioner in a full fledged trial. Petitioner has undertaken to co-operate with the investigation of the case. Hence, he can be directed to appear before the Investigation Officer within stipulated time and to co-operate with the investigation. Accordingly, the following order:
ORDER i) Petition is allowed. ii) Petitioner/accused in Crime No.73/2024 registered by Ijuru Police Station, Ramanagara, shall be released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within a period of one week from the date of receipt of a copy of this order and shall execute a personal bond for a

sum of Rs.1,00,000/- (Rupees One Lakh only) with a surety for the likesum. b) He shall furnish proof of his residential address/contact number and shall inform the I.O. in case of any change in the address/contact number. c) He shall co-operate with the investigation of the case. d) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) He shall be regular in attending the Court proceedings.
