Even otherwise, the present petition arises out of an order dated 05.04.2012 whereby the appeal of the tenant was allowed and the release application under Section 21(1)(a) of the U.P. Act No. XIII of 1972 was dismissed. 3. Considering the fact that U.P. Act No. XIII of 1972 has been repealed, the present petition is disposed of permitting the petitioner to file fresh proceedings, if so advised, under the Tenancy Act of 2021. In case, a fresh proceedings are filed, the same shall be decided within the time prescribed in the statute. The order impugned in the present petition shall not come in the way in deciding the application on its own merits in accordance with law.
