Neutral Citation No. - 2025:AHC-LKO:28069 Court No. - 18 Case :- WRIT - A No. - 5264 of 2025 Petitioner :- Anchal Yadav Respondent :- State Of U.P. Thru. Addl. Chief Secy. Bal Vikas Sewa Evam Pushtahar Deptt. Lko. And 5 Others Counsel for Petitioner :- Rahul Mishra Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for respondent no. 1 to 5. Notice to respondent no. 6 is dispensed with in view of the proposed order. By means of this petition, the petitioner seeks the quashing of the selection of opposite party no. 6 and prays for her appointment to the post of Anganwari Karyakatri in place of respondent no. 6, asserting that she is a qualified and eligible candidate for the post as per the applicable government order.. Learned Standing Counsel has opposed the petition. The written instructions provided by the learned Standing Counsel are taken on record. Perused the record. A perusal of the written instructions reveals that the petitioner’s income certificate was issued on 24.08.2024, which is more than six months prior to the advertisement dated 01.10.2024. Accordingly, in view of paragraph Ch (3) of the Government Order dated 21.03.2023, the certificate cannot be considered valid. In contrast, Anju Yadav, who has been selected under the BPL category, was issued an income certificate on 03.11.2024, which is in conformity with the Government Order dated 21.03.2023. Hence, in view of the above, it appears that the selection has been made strictly in accordance with the terms of the advertisement and the Government Order dated 21.03.2023. So far as the ground of the petitioner that the advertisement does not contain the condition that the income certificate ought to have been issued within six months from the date of advertisement is concerned, a perusal of the advertisement dated 21.10.2024 clearly indicates that the procedure outlined in the Government Order dated 21.03.2023 shall be adhered for appointments to the post of Anganwari Karyakatri. The said Government Order mandates that the income certificate must have been issued within six months from the date of the advertisement. Thus, the petition lacks merit and is accordingly dismissed.
