The petitioner seeks initiation of contempt proceedings against the respondents for non-compliance of the Judgment dated July 09, 2013, passed in SWP No. 1867 of 2010 (Bhushan Lal Koul Vs. State of J&K and Ors.) vide which the Writ Court had disposed of the petition preferred by the petitioner by providing that respondents shall calculate interest payable to the petitioner on his GPF balance for the period of October, 2004 to January, 2008, per GPF Rules within a specified time. The Statement of fact filed on behalf of the respondents show that the claim of the petitioner was examined by the respondent-authorities in the right earnest:
“D. That admittedly the case of the petitioner was for the first time received in the Funds Organization on 24-01-2007 but on receipt of the same, some discrepancies were detected in the case and those discrepancies were got removed and deficiencies completed from the petition upto January 2008. These discrepancies/deficiencies are – i. Position of ledger card viz; debit/credit awaited from CAO DFO Jammu Refer CAO DFO Doda letter No. DFOD/296-98 dated 19-06- 2007 and No. DFOD/1854-55 dated 26-12-2007 (Annexure “A &B”). ii. Clarification of Adjustment of debit Rs. 6000/- received from AO DFO Srinagar vide letter No. DFO/Sgr/4th/42-43 dated 26-10-2007 (Annexure “C”). iii. Leger position received from AO G.P. Fund Migrant Cell Jammu vide No. GPF/Mig/3299 dated 18/1/2008. On 2nd of February 2008 the final payment authority of FP fund balance along with interest up to 31st October 2004 total amounting to Rs. 507724/= was issued in favour of the petitioner which was duly Sr.No. 10

received by him. Thereafter, a further amount/residual balance of Rs. 15510/= on account of missing credits prior to 03/2008 was also released in favour of the petitioner and thus the GP fund claim of the petitioner was settled full and final. Rule 20 of GP Fund Rules as applicable to the case of the petitioner allows interest on the deposit upto 6 months only in case the in case the pension case of an employee reaches the Funds Office beyond the period of 6 months and thereafter the deposits are automatically transferred to the General fund on which no interest is paid. E. That the direction of this Hon’ble Court is very clear that the case of the petitioner for payment of interest for the period of Oct.
2004 to January 2008 be calculated in accordance with the GPF Rules governing the field. Since the case of the petitioner reached the Funds Office beyond the period of 6 months from the date of retirement of the petitioner and the delay is not attributable to the answering respondents but either to the petitioner r the Chief Education Officer Doda so the order passed by the respondent No. 2 is complete compliance of the order of this Hon’ble Court and under no circumstances can be treated as violative of the directions of this Hon’ble Court.”
