CMP(M) No.785 of 2025 Keeping in view the grounds given in the application, duly supported by an affidavit of the official, delay of 68 days’ in filing the appeal is condoned. Application stands disposed of. LPA No.540 of 2025 & CMP No.19675 of 2025 Notice be issued to the respondent returnable within a period of four weeks on taking steps within a week. Inter alia submits that the specific plea taken by the State in its written statement was that the land was taken for construction of the Kandhar to Beral road in the year 1990 and reference was also made to the sanction of Rs.34,53,000/- as such to plead that it was done with the consent of the people. Reference was made to a subsequent resolution passed regarding this aspect on 23.02.2022 (Annexure R-1) regarding litigation initiated by other persons inspite of the consent given earlier which has been discounted by the learned Single Judge in Para 7. Reliance has been placed upon the pendency of LPA No.337 of 2025 titled State of H.P. and another versus Punit Bashtu, to contend that similar issues are pending before this Court. To be heard along with LPA No.337 of 2025 on 14.10.2025. In the meantime, Implementation of the said order of the learned Single Judge shall remain stayed. ( G.S.
