The present appeal under Section 14 (A) (1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been preferred assailing the impugned order dated 24.02.2025 passed by learned Special Judge (SC/ST Act), Lucknow in Sessions Case No. 161 of 2024 whereby charges were framed by the said court under Sections 493, 504 & 506 IPC and Section 3 (1) (r) (s) of the SC/ST Act. 3. Before arguing the matter on merits, learned counsel for appellant has drawn the attention of this Court towards impugned order dated 24.02.2025 passed by learned Special Judge (SC/ST Act). The said order has been signed by Shri Vivekanand Sharan Tripathi, Special Judge (SC/ST Act), Lucknow on 24.02.2025. The name of the Presiding Officer as mentioned in the recital of the said order is different from the Special Judge (SC/ST Act), who has signed passed the said order. 5. Without commenting any further, the impugned order has clearly been passed without application of mind to such extent that the trial court has not even bothered to check and corrected his own name in the recital of the order. It is not expected that Special Judge (SC/ST Act), who is drawing charges in serious offences would overlook such basic errors pertaining to his own name. 6. Accordingly, the error pointed out by learned counsel for appellant is apparent from the face of the record and therefore, requires interference by this Court. 7. In light of the above, impugned order dated 24.02.2025 passed by learned Special Judge (SC/ST Act), Lucknow in Sessions Case No. 161 of 2024 under Sections 493, 504 & 506 IPC and Section 3 (1) (r) (s) of the SC/ST Act is set aside. The matter is remitted to the Special Judge (SC/ST Act), Lucknow to pass fresh orders in accordance with law with expedition. . (Alok Mathur, J.)
