Advocate 3 Hon'ble Shri Ramesh Sinha, Chief Justice Hon'ble Shri Arvind Kumar Verma , Judge Order on Board Per Ramesh Sinha , Chief Justice 29.04. 2025 1 Heard Mr. Gyan Prakash Shukla, learned counsel for the appellant as well as Mr. Shaleen Singh Baghel, learned Deputy Government Advocate, appearing for the State. 2 The present petition has been filed by the petitioner with the following relief(s): “10.1 That, the Hon’ble Court may kindly call for the records pertaining to encroached situated in Village Rajapur, Khasra Number 503, Tehsil and District Surajpur. 10.2 That the Hon’ble Court may kindly direct the respondents authority to take necessary action for removing the encroachment upon Government land bearing Khasra no.503, situated in Village Rajapur, Tehsil and District Surajpur, in the interest of justice. 10.3 That the Hon’ble Court may kindly direct the respondents to restrain the private respondents from raising further construction, in the interest of justice. 10.4 That, any other relief, which this Hon’ble Court may deemed just and fit in the facts 4 and circumstances of the case.” 3 After arguing for some time, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to approach before the appropriate forum for redressal of his grievance. 4 Learned counsel for the State has no objection. 5 Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty, as prayed for in favour of the petitioner.
