IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.7691 of 2025 Date of Decision: 09.05.2025 _______________________________________________________ Poonam Thakur …….Petitioner Versus State of Himachal Pradesh & Others ….Respondents _______________________________________________________ Coram: Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? 1 For the Petitioner: Mr. Ashwani Kaundal, Advocate. For the Respondents: Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C.Verma, Additional Advocate Generals and Mr. Ravi Chauhan, Deputy Advocate General, for State. ____________________________________________________ Sandeep Sharma, Judge(oral): By way of instant petition, petitioner has made very innocuous prayer to issue directions to respondents to consider and decide her pending representation dated 04.03.2025 (Annexure P-4), in time bound manner. 2. Careful perusal of averments contained in the petition as well as representation (Annexure P-4) reveals that on account of medical problem of her daughter, petitioner has prayed for transfer from present place of posting, to a station near her village. 3. Having regard to the nature of prayer and order proposed to be passed, this Court sees no necessity to call for reply on behalf of respondents, who are otherwise represented by Mr. Ravi Chauhan, 1Whether the reporters of the local papers may be allowed to see the judgment? 2 learned Deputy Advocate General. Mr. Chauhan fairly states that representation, if not already decided, shall be decided expeditiously. 4. Having taken note of the fact that petitioner has already completed normal tenure of posting at present place of posting, coupled with the fact that transfer policy formulated by the Government of Himachal Pradesh enables an employee to seek transfer on account of adverse family circumstances, this Court sees no impediment in issuing direction to respondents to consider and decide the pending representation dated 04.03.2025 (Annexure P-4), in time bound manner. 5. Consequently, in view of the above, present petition is disposed of with the direction to respondents to consider and decide the pending representation dated 04.03.2025 (Annexure P-4) filed by the petitioner, expeditiously, preferably, within a period of four weeks. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders thereupon taking note of adverse family circumstances of the petitioner. Pending applications, if any, stand disposed of. p (Sandeep Sharma), Judge May 09, 2025 (Rajeev Raturi)
