Order on Board 29.07.2025
1. The petitioner has filed this petition seeking the following relief(s) :
“10.1.Issue a writ of mandamus against the respondents and in favour of the petitioner by quashing the impugned order dated 24.12.2020 (Annexure P/1) and further be pleased to direct the respondents to induct the petitioner in service on compassionate ground; 10.2.Issue a writ in favour of the petitioner that a dependent sister-in-law is entitled for compassionate appointment;
10.3. Any other relief which this Hon'ble Court deems fit in the
facts and circumstances of the case, in the interest of justice.”
2. The Sister-in-law of the petitioner (elder sister of the petitioner's husband) REKHA SINGH
-2- died of Cancer on 20.05.2020. Satyawati Bhagat was working on the post of Assistant Grade-II under the respondents. The deceased/Satyawati had two brothers and six sisters. The eldest brother Suresh died few years ago and the younger brother Virendra married the present petitioner. The elder sisters of the deceased are married and leading their life separately in their matrimonial houses. The husband of the petitioner had applied for compassionate appointment which was rejected on the ground that he had crossed the maximum age limit of 40 years on 08.08.2020, therefore, the petitioner moved a fresh application for grant of compassionate appointment. The claim of the petitioner has been rejected citing Clause 5(5) of the Circular No.830 dated 11.04.2018 which states that the petitioner would not be eligible for compassionate appointment as she is neither a dependent brother nor dependent sister.
3. A perusal of the pleadings made in the writ petition and the provisions of Clause 5(5) of the Circular dated 11.04.2018 would make it clear that the petitioner was not entitled for compassionate appointment as she is neither dependent brother nor dependent sister of the deceased, therefore, in my opinion, no case is made out for interference. This petition fails and is hereby dismissed. No cost(s). Sd/-
