The petitioner prayed for following reliefs:- "a. Issue a Writ, in the nature of Mandamus thereby directing the respondent No. 02 i.e. District Magistrate, District Gonda, to take concrete action over the grievance of the petitioners by punishing the respondent No. 03 and 04 who have stopped the construction of the petitioners without any litigation and even without any reason to construct their house over the land Gata No. 383 (C), situating in Village Majha Tarhar (Madhaipur), Tehsil- Gonda Sadar, Distt.- Gonda. b. Issue a Writ, in the nature of Mandamus thereby restraining the respondent No. 03 and 04, not to interfere in the peaceful possession and construct over the land Gata No. 383 (C), situating in Village Majha Tarhar (Madhaipur), Tehsil- Gonda Sadar, Distt.- Gonda." 3. Such disputes cannot be decided in writ jurisdiction, specially as it is alleged that orally the respondent nos.3 and 4 are interfering in the matter. 4. At this stage, learned Chief Standing Counsel, on the basis of instructions, states that the police is not interfering in the dispute pertaining to the land bearing Gata No.383(C). 5. The writ petition is, accordingly, disposed of with liberty to the petitioner to avail other remedies, whether before the higher authorities or the court concerned.
