Neutral Citation No. - 2025:AHC-LKO:28031 Court No. - 18 Case :- WRIT - A No. - 5281 of 2025 Petitioner :- Smt. Archna Devi Respondent :- State Of U.P. Thru. Its Addl. Chief Secy. Deptt. Of Bal Vikas Evam Pushtahar Lko. And 5 Others Counsel for Petitioner :- Alok Kr. Misra,Surjeet Kumar Mishra Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. In view of the proposed order being passed, notices to respondent No.6 is dispensed with. Heard learned counsel for the petitioner and learned standing counsel for the State-respondents. Learned counsel for the petitioner submits that respondent No.6 has been selected on the basis of the incorrect income certificate issued in her favour although she is having adequate properties. Learned standing counsel, on the basis of written instructions which are taken on record, has opposed the contention and has submitted that the petitioner is a BPL category candidate who has secured 9.6 marks in merit whereas respondent No.6-Manju Devi is also BPL category candidate and has got highest marks i.e. 10.065 marks in merit. Perused the record. So far as the contention of the learned counsel for the petitioner that income certificate on the basis of which the selected candidate has been considered is wrongly issued, no prayer seeking quashing of the income certificate of the selected candidate has been made. The selection appears to have been conducted strictly on the basis of merit. Both petitioner and respondent No.6 are BPL category candidate, the procedure provided under Government Order dated 21.03.2023 appears to have been strictly adhered to. There appears to be no illegality in the selection and thus, the petition being devoid of merits is accordingly dismissed.
