Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer for direction to learned Civil Judge (SD)/FTC/Additional Chief Judicial Magistrate, Sultanpur to proceed and commit the case for the trial of Criminal Case No. 1285 of 2023 (old Case No. 11843 of 2021), under Section 376D, 504, 506 IPC, Police Station Motigarpur, District Sultanpur, after taking necessary steps against the accused persons, expeditiously. Learned counsel appearing for the applicant submits that the matter pertains to the year 2023, but even after passing of two years, the committal of the case has still not been done. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to commit the case for trial within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the learned trial court concerned is directed for committal of the trial of Criminal Case No.1285 of 2023 (old Case No. 11843 of 2021), under Section 376D, Versus Counsel for Applicant(s) : Ram Lakhan Vishwakarma, Sumer Chandra Counsel for Opposite Party(s): G.A. Kritija .....Applicant(s) State Of U.P. Thru. Addil. Chief Secy. Home Deptt. Lko. And 3 Others .....Opposite Party(s) 504, 506 IPC, Police Station Motigarpur, District Sultanpur, if the same has still not been done, with expedition, in accordance with law, considering the instructions and guidelines issued by this court; time to time.
