Neutral Citation No. - 2025:AHC-LKO:27245 Court No. - 18 Case :- WRIT - A No. - 5160 of 2025 Petitioner :- Smt. Rachana Devi Respondent :- State Of U.P. Thru. Secy. Bal Vikas Evam Pushtahar Deptt. Lko And 5 Others Counsel for Petitioner :- Mukesh Kumar Shukla Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned standing counsel for the State-respondents. Learned counsel for the petitioner has submitted that the petitioner is a widow who belongs to BPL category and has also secured highest merit however, ignoring her the private respondent No.6-Sangeeta has been selected. Learned standing counsel, on the basis of written instructions which are taken on record, has opposed the contention. Perused the record. A perusal of the written instructions shows that in view of paragraph (ग) (i) of the Government Order dated 21.03.2023, one Sangeeta who is a widow belonging to below poverty line category and has secured 11.67 marks which are highest has been given first priority. On the contrary, the petitioner though is also a widow and BPL category candidate however, has secured only 6.46 marks in merit and thus, being lower in merit, she has not been selected. There appears to be no illegality in the impugned selection. The writ petition being devoid of merits is accordingly dismissed.
