Application U/S 482 No. 924 of 2025 has been filed by Smt. Meenakshi Ramchandani with the prayer for quashing of the impugned summoning order
dated 15.7.2023 and proceedings initiated on 4.7.2024 in Criminal Misc. Case No. 2681 of 2021 before the Special Chief Judicial Magistrate (Custom), Lucknow. Application U/S 482 No. 849 of 2025 has been filed by Shri Prajwal Lalchandani with the prayer for quashing of the Case No. 55605 of 2021, arising out of FIR No. 0175 of 2020 under Sections 323, 504, 506, 498-A IPC and Section 3/4 Dowry Prohibition Act. All the above mentioned cases have been filed by the parties and involves matrimonial dispute, hence, they are decided by a common judgement. It has been submitted by learned counsel for the parties that they have resolved their dispute through a settlement agreement before the Mediation and Conciliation Center of this Court. They have agreed to withdraw/not to pursue all pending cases between them.
The details of the cases have been mentioned in paragraph 6B of the settlement agreement, which reads as under:
"(i) Complaint Case No. 1249 of 2020 (Meenakshi Ramchandani (Vs. Prajwal Lalchandani) U/S 125 Cr. P. C. filed before Principal Judge, Family Court, Lucknow. (ii) F.I.R. No. 0175 of 2020 U/S 498A, 323, 504, 506, I.P.C. pending before ACJM-I Lucknow (iii) Case No. 5073 of 2020 U/S 12 D. V. Act pending before ACJM-I, Lucknow (iv) Case No. 3171 of 2020 U/S 9 of Hindu Marriage Act, 1955 pending before Principal Judge, Family Court, Lucknow. Clause C of paragraph 6 of the agreement further states that second party has agreed not to have any objection if this Court decides the Criminal Revision No.526 of 2023 Smt. Meenakshi Ramchandani vs. State of U.P. and another in terms of this settlement agreement. Perused the record so also the settlement agreement, which is on record and also
the report of the mediation Center. Since the parties have amicably resolved the dispute pending between them, which was primarily of matrimonial in nature, I am of the view that no purpose will be solved by keeping the matter pending. Considering the above as well as law laid down by the Hon'ble Supreme Court of India in the case of (2008) 16 SCC 1, Gian Singh versus State of Punjab, the proceedings impugned in all the cases, mentioned above, are liable to be and are hereby quashed. All the cases (supra) are accordingly allowed. Order Date :- 10.2.2025 Madhu D.R/P.S Digitally signed by :- MADHU KUMARI High Court of Judicature at Allahabad, Lucknow Bench
