BEFORE HONOURABLE MR. JUSTICE NELSON SAILO ORDER Date : 14.10.2025
Heard Mr. M. R. Adhikari, learned counsel for the petitioner and Ms. N. Phukan, learned Standing Counsel, Elementary Education Department, for the respondents concerned. [2.] On 23.05.2025, this Court passed the following order:-
“The petitioner is working as Assistant Teacher in Balia Punjee Halam Tribal L.P School in the district of Karimganj, Assam and by filing this writ petition, he has claim for payment of his arrear salaries with effect from 01.01.2013 to 29.02.2016. It is the case of the petitioner that the Head Teacher of the same school having similar grievance had approached this Court through WP(C) No. 6241/2022 and that the respondents have already paid what was due to the said Head Teacher on 09.06.2023. Therefore, the petitioner prays for a direction to the respondent to immediately pay the arrear salaries to him. Mr. B. Talukdar, learned Standing Counsel, Elementary Education Department submits that he may be given some more time to get

20.06.2025. If no instructions are forthcoming, Court may consider passing appropriate order.” [3.] Today, the learned Standing Counsel submits that the Joint Director, Elementary Education Department has written to the District Elementary Education Officer (DEEO), Sribhumi to submit a fresh proposal regarding the arrear salary. The learned Standing Counsel submits that some more time may be granted to obtain instructions.
[4.] It is however, seen that this Court had already granted enough time to the respondent authorities to do the needful and therefore, this Court is not inclined to grant any further time. The writ petition is therefore disposed of with a direction to the respondents to do all the needful and work out the arrear salaries payable to the petitioner and pay him the same as expeditiously as possible and at any rate, within the outer limit of two (2) months from the date of receipt of a certified copy of this Order.
