District And Session Judge, Court No. 09,Raebareli And 3 Others Counsel for Petitioner :- Shailesh Kumar Srivastava,Sachchidanand Mishra Counsel for Respondent :- Ramesh Kumar Srivastava Hon'ble Pankaj Bhatia,J.
1. No one is present for the petitioner to press the petition even in the revised call.
2. The present petition has been filed challenging the order dated 31.10.2019, whereby, the suit for arrears of rent and ejectment was decreed in favour of the landlord as well as the revisional order dated 19.04.2022, whereby the revision was dismissed.
3. The facts in brief are that, the landlord claiming himself to be the owner instituted a suit for rent and ejectment with the allegation that despite service of notice, the rent was not being paid. After analyzing the evidence as many as 10 points for determination was framed by the trial court. The trial court after analyzing the evidence including the rent agreement, recorded that the tenant has not paid the payment of rent and as such, the suit in question came to be decreed. The revisional court also dismissed the revision by affirming the findings.
4. Considering the fact that the suit in question was decided and, thereafter, the revision was dismissed and both the orders have recorded findings of fact, no interference is warranted.
5. The petition lacks merits and is, accordingly, dismissed.
6. Learned counsel for the respondent states that even in terms of the order passed by this Court, the rent has not been paid by the petitioner, as such on that count also, the writ petition deserves to be dismissed and is, accordingly, dismissed.
