Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as accused Crime No.897 of 2024 of Penamaluru Urban Police Station, Krishna District, registered for the alleged offence under Sections 192, 196(1), 336(4), 340(2), 353(2), 79 of the Bharatiya Nyaya Sanhita, 2023, Section 67 of the Information Technology Act, 2000-2008, on the strength of the complaint of the 2nd respondent. 3. It is alleged in the complaint that the petitioner posted abusive content on the social media platform, i.e., Facebook, against political leaders. On account of political rivalry, the petitioner was falsely implicated in the crime. The learned counsel further submits that the offences alleged against the petitioner are punishable by imprisonment of less than 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Penamaluru Urban Police Station, Krishna District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar 3 CRL.P. No.3280 of 2025 as the petitioner is concerned, for the purpose of investigation in connection with Crime No.897 of 2024. It is made clear that this order would not preclude the investigation officer to file charge sheet or final report after completion of investigation in the said crime. 5.
