This Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for quashing the entire proceedings of Criminal Case No.649 of 2024, “State vs. Harish Negi and Others”, pending before the court of Judicial Magistrate/ Civil Judge, Sitarganj, District Udham Singh Nagar under Sections 323, 498A, Section 504 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 2. Mr. Bhupendra Singh Koranga, learned counsel for the applicants. 1 2025:UHC:9983 3. Mr. Tumul Nainwal, learned Assistant Government Advocate for the respondent no.1. 4. Mr. Suraj Singh Koranga, learned counsel for the respondent no.2- informant – victim. 5. Applicant no.1 is the husband of the respondent no.2. The applicant no.2 is the mother and the applicant no.3 is the father of the applicant no.1. 6. All the applicants are present in-person. They are identified by Mr. B.S. Koranga, Advocate. 7. The respondent no.2 is present in-person. She is identified by Mr. Suraj Singh Koranga, Advocate. 8. Both, the applicants and the respondent no.2 submitted that there were matrimonial disputes. The applicants and the respondent no.2 have further submitted that they are living jointly and happily. The respondent no.2 has requested to quash the entire proceedings of Criminal Case No.649 of 2024. 9. The said request of learned counsel for the respondent no.2 has not been opposed by learned counsel for the respondent no.1. 10. Considering the totality of the matter, this Court is of the view that ends of justice would be met if 2 2025:UHC:9983 the entire proceedings of Criminal Case No.649 of 2024, “State vs. Harish Negi and Others”, pending before the court of Judicial Magistrate/ Civil Judge, Sitarganj, District Udham Singh Nagar, are quashed. 11. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and entire proceedings of Criminal Case No.649 of 2024, “State vs. Harish Negi and Others”, pending before the court of Judicial Magistrate/ Civil Judge, Sitarganj, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 12.11.2025 ALOK KUMAR VERMA, J.
