Neutral Citation No. - 2025:AHC-LKO:27081 Court No. - 18 Case :- WRIT - A No. - 5097 of 2025 Petitioner :- Smt. Pinki Respondent :- State Of U.P. Thru. Prin. Secy. Child Development Service And Nutrition, Lko. And 5 Others Counsel for Petitioner :- Shesh Mani Shukla,Sarvesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for respondent Nos. 1 to 5. Notice to respondent no. 6 is dispensed with in view of the proposed order. By this petition, the petitioner has prayed for the following relief:- (i) Issue a writ, order or direction in the nature of certiorari thereby quashing of the impugned final selected candidate list dated 22-03-2025 issued by the opposite parties, illegally and arbitrary manner and also without considering the eligible candidate for the post of Aganbadi Worker, which copy is annexed as Annexure No.1, in the interest of justice. (ii) Issued a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite party No.5 to issue a fair merit list in pursuance of the Government order dated 21-03-2023 (Contained as Annexure No.5 to this writ petition) in respect of the advertisement dated 21-10-2024 (as contained in Annexure No.2 to this writ petition). Learned counsel for the petitioner submits that the respondents, while selecting opposite party no. 6, did not follow the procedure laid down in Paragraph 7(1) of the Government Order dated 21.03.2023, and no merit list including the petitioner was prepared. Learned Standing Counsel, on the basis of written instructions along with relevant annexures, submits that the petitioner’s income certificate was issued on 13.08.2019, which is more than six months prior to the date of the advertisement. As per the Government Order dated 21.03.2023, such a certificate could not be considered valid. It is further submitted by the Learned Standing Counsel that the petitioner was called for physical verification of documents. During physical verification of the certificate, she committed forgery by altering the date on the income certificate from 13.08.2019 to 08.11.2024. Consequently, the income certificate could not be verified, and the petitioner was not selected. Perused the record. A perusal of the written instructions, particularly paragraph 3, indicates that the income certificate was originally issued on 13.08.2019, as per the registration records. During the physical verification process, the petitioner committed forgery by submitting a self-attested income certificate in which the date was altered from 13.08.2019 to 08.11.2024. Consequently, the certificate could not be verified, and the petitioner was not selected. There appears to be no illegality in the non-selection of the petitioner. The writ petition, being devoid of merit, is accordingly dismissed. The written instructions submitted by the Learned Standing Counsel are taken on record. Order Date :- 8.5.2025/R.C.
