The petitioner had taken some loan under the Dairy Scheme from the opposite parties in the year 2013-14. He admittedly has not been able to repay the loan and auction proceedings were scheduled. He has challenged a notice for auctioning the property which was mortgaged in lieu of the said loan. The Bank's counsel says that he has no objection if the petitioner wants to pay back the loan in easy installments. He also says that the amount to be paid by the petitioner as on 07.05.2025 was Rs.2,98,330/-. The Bank should provide statement of loan account to the petitioner within a week, thereafter, the petitioner shall pay the due amount in following manner:- (i) The petitioner shall deposit a sum of Rs.20,000/- within fifteen days from today. (i)The petitioner shall pay the remaining amount in four quarterly installments. The last installment shall contain the residuary amount including interest till the last installment. Subject to above, the recovery proceedings shall remain in abeyance, however, if the petitioner defaults in payment of any of the installments as aforesaid, the proceedings may be continued by the Bank and the revenue authorities.
