Neutral Citation No. - 2025:AHC-LKO:27612 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 2766 of 2025 Petitioner :- Dharmendra Kumar Alias Dharmendra Syoran Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko. And 3 Others Counsel for Petitioner :- Rakesh Kumar Agarwal,Saksham Agarwal Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondents has been accepted by the office of Chief Standing counsel. By means of the petition the petitioner seeks a direction to State Public Service Tribunal for deciding the case bearing no.Claim Petition no.1034 of 2023 (Dharmendra Syoran vs State of U.P. & ors) as expeditiously as possible. Having considered the averments and from a perusal of the certified copy of the order sheet which has been brought on record, it appears that though several dates have been fixed but on many occasions the case has been adjourned, primarily, for different dates on the basis of a prayer made by either of the parties. A specific query was put to the learned counsel for the petitioner that if once the order sheet indicates that the matter is being adjourned at the behest of the learned counsel for the parties then in what circumstances this Court may expedite the proceedings where the dates are being adjourned at the behest of the petitioner included learned counsel for the petitioner submits that it is the manner in which order sheet has been drawn by the tribunal. Be that as it may, since there is no averment in the petition that the orders which have been filed does not reflect the correct position nor there was any application for correcting the order passed by the tribunal if the orders were not correctly drawn nor any application for early hearing before the tribunal. Hence, at this stage, this Court is not inclined to entertain the petition.
It will be open for the petitioner to move the tribunal for early hearing and needless to say that the tribunal shall take note and will pass appropriate orders. It will be open for the petitioner to approach this Court in case any cause of action for expedition arises in future. The petition is dismissed with the aforesaid liberty.
