Bal Vikas Evam Pustahar Civil Sectt. Lko. And 6 Others Counsel for Petitioner :- Girish Chandra Misra,Ram Chandra Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. In view of the proposed order being passed, notices to respondent No.7 is dispensed with. Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 6. By this petition, the petitioner has prayed for the following relief:-
"a. Issue, a writ, order or direction in the nature of Mandamus thereby commanding to the opposite party no.3&5 to take decision over the claim of the petitioner for service on the post of Aaganwari Karyakatri, for village Narpatpur, Post Veerpur Khairhaniya, Block Ikauna, Tehsil Ikauna, District Shrawasti, after

to
the
petitioner. b. Issue, a writ, order or direction in the nature of Mandamus thereby commanding to the opposite party no.3&5 to give appointment to the petitioner on the post of Aaganwari Karyakatri for the village Narpatpur, Post Veerpur Khairhaniya, Block Ikauna, Tehsil Ikauna, District Shrawasti." After arguing for sometime, learned counsel for the petitioner confines his prayer to the extent that the representation of the petitioner may be directed to be decided by respondent no.5.
Learned Standing Counsel has no objection to this innocuous prayer. Perused the record. Considering the above, the petition is disposed of with liberty to the petitioner to move a fresh representation to respondent no.5 i.e. District Program Officer within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.5 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order.
