Page No.# 3/4 BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA ORDER 13.06.2025 Heard Ms. P Bhattacharyya, learned counsel for the applicant. This interlocutory application has been filed for impleadment of Lieutenant General Vikas Lakhera, AVSM, SM, the Director General, Assam Rifles as a party respondent in Cont. Case No. 369/2020. It is submitted that the respondent No. 3 in the contempt petition who was the earlier Director General, Assam Rifles has since demitted his office and the opposite party has been appointed as a Director General in his place and accordingly the opposite party is a necessary party and is therefore required to be arrayed as a party respondent. The learned CGC although copies have been served is not before the Court. Nevertheless this Court at this stage considers it appropriate to allow the interlocutory application without issuing notice as the earlier incumbent in the Office of the Director General was already as a party respondent and by way of this present Interlocutory Application, the present opposite party who had subsequently assumed office of the Director General is required to be arrayed as a party respondent.
In that view of the matter, the interlocutory application stands allowed. Lieutenant General Vikas Lakhera, AVSM, SM, Director General, Assam Rifles is arrayed as party respondent No. 4 in Contempt Petition No. 369/2020. The newly impleaded opposite party will be issued notice in the contempt petition and will get ample opportunity to file their objections if any. The interlocutory application stands allowed and disposed of. Page No.# 4/4 The applicant shall file amended cause title before the Registry within two weeks from today. JUDGE Comparing Assistant
