D/L - 22 10/03/2025 Court. No. 6
S.Kundu
C.O. 833 of 2025
Sri Samir Majhi & Ors. Vs. Sri Sankar Majhi & Ors.
Mr. Debjit Mukherjee, Mr. Kaustav Bhattacharjee, Ms. Priyanka Jana …for the petitioners.
This application is at the instance of the decree- holder praying for a direction upon the learned Civil Judge (Junior Division), 5th Court at Howrah to dispose of the Misc. Case No. 110 of 2024 arising out of Title Execution No. 23 of 1995 expeditiously. Ms. Jana, learned advocate appearing for the petitioners submits that the hearing of the miscellaneous case is being unnecessarily delayed. Mr. Mukherjee, learned advocate appearing for the petitioners submits that the opposite party nos. 1 and 3 are avoiding service in the miscellaneous case. From the order-sheet appended to this application, this Court finds that on 2nd June, 2025 has been fixed for service return and acknowledgement due. In view thereof, this Court is not inclined to pass any pre-emptory direction for expeditious hearing of the miscellaneous case.
2 Accordingly, C.O. 833 of 2025 is disposed of by requesting the learned Civil Judge (Junior Division), 4th Court at Howrah to make an endeavour to see that the Misc. Case No. 110 of 2024 be disposed of expeditiously after the same is made ready for hearing. Accordingly, C.O. 833 of 2025 stands disposed of.
