Learned counsel for petitioner fairly submits that since part of order dated 02.09.2009 was not challenged when this writ petition was filed in 2015 and since now the petitioner has attained the age of superannuation on 31.03.2023, therefore, he fairly submits that instead of pressing Amendment Application, this writ petition may be dismissed as withdrawn with liberty to file afresh petition since adverse part of aforesaid order ought to be challenged as its legal consequences are adverse. 3.
