The present appeal is directed against impugned judgment of conviction and order of sentence dated 05.11.2007 passed by the Sessions Judge, Bilaspur (C.G.) in Sessions Trial No.145/2007, whereby and whereunder, the appellant stands convicted under Sections 376 and 450 of IPC & 2 sentenced to undergo R.I. for 10 years with fine of Rs.1,000/- and R.I. for two years with fine of Rs.500/- respectively, with default stipulation. 2. In pursuance of this Court’s order dated 27.03.2025, bailable warrant was directed to be issued against the appellant and the same has been received with a note that the sole appellant left for heavenly abode on 29.03.2018. 3. The service report of the bailable warrant is supported by the report of S.H.O., Torwa, District Bilaspur (C.G.) with the death certificate of the appellant. 4. Learned State counsel has verified the fact and confirms the death of sole appellant. 5. Thus, in view of the death of sole appellant and in absence of any application for bringing his legal representatives on record, the appeal abates and the same is dismissed as abated.
